City ZBA reaffirms decision after court appeal

August 1, 2014

Almost exactly one year from originally considering a variance for a deck, and after a court appeal, the city of Dunkirk Zoning Board of Appeals came to the same conclusion....

I agree. Anything else would be pretty stupid. Pay the fee/fine whatever, and be done with it.

Having served on the Zonin Board of Appeals I can affirm that these are not always easy decisions. The criteria that I felt was important was "does the project alter the essential character of the neighborhood?" I would have approved the subject project. Many of our neighborhoods are tight but we should not deny investment within reason.
