$25M lawsuit over inmate who died in hot NYC cell

May 16, 2014
Associated Press

NEW YORK (AP) — An attorney for the mother of a mentally ill veteran who died in a 100-degree New York City jail cell is taking another step toward suing the city.

Attorney Derek Sells said at a news conference Friday that he has filed court papers to demand the city preserve all communication related to the death of the inmate, Jerome Murdough (muhr - DOH').

He says Murdough, a 56-year-old former Marine, should have had around-the-clock supervision while jailed at Rikers Island following a misdemeanor trespassing arrest.

A city official who isn't permitted to talk about an ongoing investigation and spoke on the condition of anonymity says Murdough "basically baked to death" in February after his cell overheated due to an equipment malfunction. Officials say his cause of death hasn't been determined.

Murdough's mother tells reporters she feels terrible.
