Two arrested in area burglaries
POMFRET After a two-week investigation the Chautauqua County Sheriff's Office has arrested two Brocton residents on burglary and other charges.
Lynne M. Austin, 48, and David M. Austin, jr., both of 5548 Webster Road, Brocton, have been charged with two counts each of burglary, fourth-degree grand larceny and fourth-degree criminal mischief.
The two allegedly burglarized two residences in the town of Pomfret; one on Webster Road and another on Ellicott Road. It is also alleged the two burglarized two homes in the town of Portland and charges are expected to be filed in that jurisdiction. Investigators believe the two may also be involved in four additional burglaries.
According to sheriff's, both subjects have given statements admitting to the four burglaries in the Pomfret-Portland area.
During the investigation, leads were developed that a male and a female in a blue sedan with a dog were committing the burglaries. Investigators placed a number of marked and unmarked patrol vehicles in the area of the burglaries.
After a burglary on Thursday around 11 a.m., investigators worked the area and around 2 p.m., spotted a male subject walking on Ellicott Road and a blue sedan parked on Harmon Hill Road with a female driver.
The subject, later identified as Austin, Jr., was found in possession of burglary tools. Both subjects allegedly admitted to the burglaries.
Permission to search the vehicle and their residence was granted and stolen items were found. A box of jewelry was also found buried in the back yard.
Items recovered included three long guns, silverware and jewelry. The subjects also lead investigators to three safes in the woods on Campbell Road in Portland after a burglary.
Austin and Austin, Jr. were taken to Town of Pomfret Court and committed to Chautauqua County Jail in lieu of $50,000 cash or $100,000 property bail.
Additional charges are expected to be filed as the investigation continues.
State police at Jamestown
SINCLAIRVILLE - On May 12, Ryan Robbins, 22, of Sinclairville was charged with illegal burning.
State troopers responded to his residence for the report of a large fire. Reportedly, Robbins had set fire to several large pieces of furniture in an attempt to dispose of them.
Troopers contacted the Sinclairville Volunteer Fire Department which responded to the scene and extinguished the fire.
Robbins was issued an appearance ticket for the Town of Gerry Court.
RANDOLPH - On May 16, Mary Butler, 54, of Gerry was charged with second-degree aggravated harassment.
A trooper responded to a residence for a harassment complaint. Reportedly the complainant and Butler were advised by a trooper on a previous occasion to stop contacting each other. Allegedly Butler continued to call and text the complainant.
Butler was processed at state police headquarters in Jamestown, arraigned in the Town of Napoli Court, and remanded to the Chautauqua County Jail.
GERRY - On May 16, Bruce Crawford, 23, of Jamestown was charged with second-degree aggravated harassment.
A trooper responded to a harassment complaint in Gerry. Crawford reportedly sent text messages to the female victim, threatening to cause her physical harm and threatening that others would cause her physical harm.
Crawford was issued a ticket and will appear in the Town of Gerry Court.
RANDOLPH - On Monday, Virginia Miller, 34, of Napoli was charged with larceny. It is alleged she removed firewood from the complainant's yard without permission.
Miller was transported to state police barracks in Jamestown where she was processed and issued a ticket. She is scheduled to appear in the Town of Randolph Court.
ELLICOTT - On Tuesday, Shawn Sobczak, 24, of Lakewood was charged with first-degree aggravated unlicensed operation, driving while ability impaired by drugs, second-degree criminal impersonation, and seventh-degree criminal possession of a controlled substance.
A trooper had pulled Sobczak's vehicle over on Interstate 86 for reportedly speeding. The trooper believed Sobczak was under of the influence of an unknown drug. Reportedly, he originally gave the trooper a different identity. After learning Sobczak's true identity, the trooper reportedly found Sobczak's license had been suspended multiple times. A search of the vehicle reportedly revealed an unlabeled bottle containing 33 vicodin tablets. Vicodin is a controlled substance for which Sobczak reportedly does not have a prescription.
Sobczak was arraigned in the Town of Ellicott Court and remanded to the Chautauqua County Jail.
Fredonia Police Department
Samantha S. Kellogg, 22, of Eagle Street was charged with violating the noise ordinance on May 18. At 2:25 a.m. police responded to 138 Eagle St. for the complaint of loud music. Kellogg had been previously told earlier in the evening to keep the music down. She was released on an appearance ticket.
Frank C. Battaglia, 56, of Gardner Street was charged with third-degree aggravated unlicensed operation and operating without stop lights on May 21. At 11:51 p.m. police observed Battaglia operating on Matteson Street without a driver's side brake light. He also had a suspended license. He was released on his own recognizance to appear in court at a later date.
Nicole Pelsey, 40, of Chestnut Street was charged with third-degree aggravated unlicensed operation of a motor vehicle and operating a motor vehicle without an interlock device on May 22. Police stopped Pelsey at 4:30 p.m. at the East Main Street Crosby Mart. Pelsey has a revoked license. Pelsey also failed to have an interlock device on her vehicle. She was released on an appearance ticket.
Tylah M. Dejesus, 43, of Lake Shore Drive West, Dunkirk was charged with third-degree aggravated unlicensed operation of a motor vehicle and having a suspended registration on May 22. At 4:20 p.m. Dejesus was stopped while traveling north on Chestnut for a suspended registration due to an insurance lapse on July 15, 2011. Police also discovered Dejesus' license was suspended. Dejesus was released on $250 bail and the vehicle was towed to Mancuso's Service Center.
