Troopers charge man with felony driving while ability impaired

Troopers reported Fuller drove across the yellow double solid line while traveling north. Troopers said Fuller was impaired by drugs.

Fuller was issued traffic tickets returnable to the Town of Dunkirk Court.

At 3:15 a.m., deputies responded to the scene of a one-vehicle accident. It is alleged Mark E. Swanson, 55, of Sinclairville, was operating his vehicle eastbound on Bates Road when he failed to stop at the intersection of Bates and Thornton roads. Swanson's vehicle continued across Thornton Road into the woods, striking an earth embankment and came to rest against an outbuilding that had already caved in on itself.

Swanson was transported to WCA for apparent minor injuries. An investigation into the accident is continuing and charges may be filed at a later time.

ARKWRIGHT - On July 22, a Cherry Creek man was charged with DWI, moving from lane unsafely, speed not reasonable and prudent.

Around 5:50 a.m. deputies responded to Route 83 at Creek Road in the Town of Arkwright for a personal injury motor vehicle crash. Upon investigation it was determined that a vehicle driven by Tyler C. Bailey, 20, of Cherry Creek, was south bound on Route 83 when it started to leave the roadway for an unknown reason. Bailey attempted to steer the vehicle back on to the roadway and over corrected causing the vehicle to overturn. Bailey was able to free himself from the vehicle and a resident near the accident called 911 for help.

Bailey was treated at the scene by Forestville EMS and transported to a local hospital for apparent minor injures. Upon further investigation Bailey was alleged to have been intoxicated. Bailey was charged with moving from lane unsafely, speed not reasonable and prudent, and DWI. Bailey was left in the care of the hospital and will appear in the Town of Arkwright Court at a later date.

Around 7:11 p.m., Thomas McMahon, 33, of Buffalo, was observed by deputies to allegedly be in possession of marijuana on Allegany Road in Sunset Bay. McMahon was issued an appearance ticket for the charge and he was warned not to drive because of his apparently intoxicated condition.

A short time later McMahon was seen driving on Iola drive in Sunset Bay. Deputies stopped McMahon and investigation resulted in McMahon being charged with felony DWI and aggravated DWI having a BAC of .18 percent or higher. McMahon will answer the charges in the Town of Hanover Court.

On July 14, a Westfield man was charged with driving while impaired by drugs, aggravated unlicensed operation and suspended registration.

Around 10:40 p.m., deputies observed a vehicle operating suspiciously in the Town of Dunkirk and was stopped on Lakewood Drive. Walter Lanneaux, 29, of Westfield, was found to be the operator of the vehicle. After further investigation, it is alleged Lanneaux was impaired by drugs.

Lanneaux was released with traffic tickets and is to appear in the Town of Dunkirk Court at a later date.

Around 9 p.m., sheriff's patrol responded to a complaint from a Prosser Hill Road resident of someone possibly shooting at deer from the roadway.

During the investigation, two males were detained and questioned. The males denied shooting at deer, but as a result of the investigation, Ronald M. Yachetta, 20, of Jamestown, was ticketed for discharging a firearm within 500 feet of a dwelling.

Yachetta is to appear in the Kiantone Town Court at a later date.

Around 11 p.m., deputies and state police responded to the report of an unwanted person on Iola Drive in Sunset Bay. Christopher Kozlowski, 26, of Cheektowaga, was allegedly being disorderly at a local business and on Iola Drive and he was issued an appearance ticket for disorderly conduct.

A short time later deputies stopped a vehicle on Route 5 and 20 and Kozlowski was a passenger in that vehicle. Investigation into the stop resulted in Kozlowski being charged with unlawful possession of marijuana. Kozlowski will answer the charges in the Town of Hanover Court.

Around 6:50 p.m., Max McCulloch, 28, of Tonawanda, was stopped on Allegany Road in the Town of Hanover for allegedly not stopping at a stop sign. During the stop it was also discovered that McCulloch was also allegedly in possession of marijuana. He was issued tickets for both charges and will answer the charges in the Town of Hanover Court.
