The OBSERVER

Chautauqua County Sheriff's Office

Around 7 p.m., deputies observed a northbound vehicle on Iola Drive. The driver was alleged to be using his cellphone while operating the motor vehicle. Deputies stopped the vehicle and after further investigation it was alleged driver Brian L. Malczewski, 37, of West Seneca, was intoxicated. He was placed under arrest, and later released to appear in Town of Hanover Court on a later date.

At about 5 p.m. the Chautauqua County Navigation Patrol and additional resources were summoned to an overturned sailboat with three subjects, Richard Gould, 65, Carly Gould, 21 and Abby Gould, all of Jamestown, in the waters of Chautauqua Lake. Subjects were taken ashore and two were transported to WCA hospital for evaluation. Mr. Gould assisted in righting the vessel and towing it to Long Point State Park Marina. The Chautauqua County Water Emergency Team, Ashville Fire Department, Bemus Point Fire Department also assisted. It appears the incident was the result of extremely high winds and rough seas.

Around 2:15 a.m., sheriff's deputies and New York State Police and Silver Creek police responded to a call about an accident in which the vehicle was leaving the scene on Main Street in Forestville.

Upon arrival, a citizen who witnessed the accident told officers the operator of the vehicle had been squealing its tires and driving recklessly on Main Street when it struck and damaged a stone monument.

The vehicle left the scene but was observed pulling into a garage a short distance away. It was later determined that Shaun I. Ellison, 30, of Forestville, was the operator of the vehicle. Ellison was arrested and later released on his own recognizance.

Around 3 p.m., the sheriff's office received a report of an erratic operator on Route 394 in the Town of North Harmony. Sheriff's patrol located the vehicle and observed a vehicle following too closely behind another car and failing to signal 100 feet before turning onto North Maple Avenue.

The deputy stopped the vehicle and after further investigation, Patrick Kut-schke, 40, of Sugar Grove, Pa., was arrested for driving while intoxicated and later released to a friend. Kutschke will appear in the Town of North Harmony Court at a later date.

Around 2 a.m., deputies stopped a vehicle on Route 5 and 20 in the Town of Hanover for speeding and failing to maintain a single lane of traffic. Upon investigation, Matthew E. Ohleman, 23, of Cheektowaga, was placed into custody for DWI. Ohlman was issued tickets and will appear in the Town of Hanover Court at a later date.

Around 5 a.m., deputies located an abandoned vehicle off the roadway on Route 83 in the Town of Villenova.

After an investigation, it is alleged James G. Cardot, 19, of Kennedy, was in possession of the vehicle and it did not belong to him. Cardot did not have permission to be within the vehicle by the registered owner.

Cardot was issued an appearance ticket for unauthorized use of a motor vehicle and will answer to the charge in the Town of Villenova Court.
