LAWTONS - Jose Cruz, 54, of Seneca Road was charged with driving while intoxicated on April 12. Cruz was allegedly driving erratically in the village of Gowanda, where Gowanda Police stopped him in Lawtons. Troopers and Erie County Sheriff's deputies then responded, where Cruz was found to be allegedly intoxicated. He was processed at the Collins barracks and found to have a reportable blood alcohol content of .14 percent. He was released to appear in North Collins Town Court at a later date.
GOWANDA - Kaleb Mason, 25, of Collins was charged with unlawful possession of marijuana and having an open container on April 13. Troopers stopped a vehicle on Broadway Road for an inadequate exhaust. Mason, a passenger in this vehicle, was found to be in alleged possession of a pipe containing marijuana. He was also allegedly found to be in possession of an open container. He was released to appear in Persia Town Court at a later date.
COLLINS - James Luder, 43, of Collins Center was charged with driving while intoxicated on Tuesday. Police stopped Luder on Taylor Hollow Road and South Road for allegedly having no tail lights. He was found to be allegedly intoxicated during the stop. He was processed at the Collins barracks and found to have a reportable .14 percent blood alcohol content. Luder will appear in Collins Town Court at a later date.
COLLINS CENTER - Joseph Kruszka, 49, of Main Street was charged for felony driving while intoxicated on Wednesday. Police responded to the scene where a witness saw a truck spin out and travel into a ditch. The driver, Kruszka allegedly left the scene on foot, but was located walking on Main Street. Kruszka was found to be allegedly intoxicated. He was processed at the Collins barracks where he refused a breath test. A prior DWI conviction in the past 10 years made this charge a felony. He was arraigned in Collins Town Court and sent to the Erie County Holding Center on $5,000 bail. The Erie County Sheriff's Office also responded.
Chautauqua County Sheriff's Office
SHERIDAN - Lee W. Seybold, 52, of Route 20 was charged with unlawful possession of marijuana on Saturday. At 2:07 a.m., deputies were called to Seybold's residence for the report of an unwanted person. Deputies observed a leafy green substance in the residence which allegedly belonged to Seybold. He was released to appear in Sheridan Town Court at a later date.
BROCTON - Byron P. Lawton, 40, of Webster Road was charged with a probation warrant on Saturday. Deputies, along with K9 Drago, took Lawton into custody at his residence. He had an outstanding probation warrant for second-degree criminal sexual act. Lawton was taken to the Chautauqua County Jail and held without bail.
JAMESTOWN - James M. Harrier Jr., 51, of Jamestown was charged Saturday with driving while intoxicated, aggravated DWI per se with a blood alcohol content of .18 percent or higher and moving from lane unsafely after a traffic stop on Jones and Gifford streets around 9 p.m. It is alleged Harrier was intoxicated and he was taken into custody. He was released with appearance tickets for Jamestown City Court.
