CHAUTAUQUA COUNTY SHERIFF

CHAUTAUQUA — The five people involved in an accident on Stockton-Hartfield Road with a county sheriff’s vehicle and an Amish buggy have been released from Jamestown UPMC Hospital and are recovering from their injuries at home.

Those injured were: Elizabeth Byler, 50; Levi Lee, 25; Katie Lee, 25; Amos Lee, 3; and Sammy Lee, 1. The deputy involved was Dylan Pratt.

The accident occurred around 9 p.m. Sunday. Deputies reported the Amish buggy met all the New York state requirements for a slow-moving vehicle being drawn by an animal. The buggy displayed a slow-moving vehicle emblem on the rear and two lit lanterns with red lens at least 4 inches in diameter near the edge of the buggy and at least 72 inches of high quality white reflective tape.

The investigation is still ongoing with more information forth coming.

JAMESTOWN POLICE DEPARTMENT

¯ Marcus Detweiler, 19, of Sherman, was charged Monday at about 1 p.m. with seventh-degree criminal possession of a controlled substance, two counts of second-degree criminal possession of a weapon, second-degree criminally using drug paraphenalia, and third-degree criminal possession of a controlled substance. According to police, officers responded to UMPC Hospital for a male who was transported by ambulance from Sherman for a mental health evaluation. Police said officers found Detweiler in alleged possession of a loaded .25-caliber pistol, a loaded .20-guage sawed off shotgun, 10.6 grams of methamphetamine, 13.2 grams of fentanyl, pills, scale and plastic bags consistent with drug packaging. Police said Detweiler doesn’t have a valid New York State pistol permit. Detweiler was released from the hospital, arraigned and transported to the Chautauqua County Jail.

NEW YORK STATE POLICE

Two individuals are facing charges after a shoplifting incident Tuesday at the Home Depot in the town of Dunkirk

State Police at Fredonia responded to the Vineyard Drive store for the incident. When Troopers arrived on scene, store employees had Alisha H. Scinta, 52, of Dunkirk stopped in an aisle awaiting the police’s arrival.

Troopers were also outside in the parking lot interviewing a disoriented Dennis C. Weaver, 23, of Cherry Creek who stated that he was “waiting for his mother” who was inside the store.

Further investigation revealed Weaver was connected with Scinta. While being questioned, Troopers observed Weaver to have obvious signs of impairment including glassy, bloodshot eyes and impaired motor coordination as he swayed and staggered while being interviewed. Weaver was found to have a revoked state driver’s license for a previous conviction of driving while ability impaired by alcohol in 2019.

A review of surveillance footage and a vehicle search would later locate merchandise that was stolen from Home Depot the previous day by Scinta. Both suspects were transported to Fredonia barracks for processing.

Scinta was charged with fourth-degree grand larceny and petit larceny. Weaver was charged with driving while ability impaired by drugs and first-degree aggravated unlicensed operation as well as other vehicle and traffic violations.

Both were released with tickets returnable to the town of Dunkirk court later.
