Two Jamestown businesses fined for selling tobacco products

Two Jamestown businesses have been fined for selling tobacco products to a minor.

During the Chautauqua County Board of Health meeting, it was announced that Smoke Town located on Newland Avenue Jamestown had sold a flavored vape to an individual under 21 years of age.

It is illegal to sell flavored vapes as well as to sell legal tobacco products to minors.

Jessica Wuerstle with the county Board of Health said the owners declined to sign the agreement to settle, which would have been $900, and instead chose to go before a hearing officer.

Wuerstle said they did not appear at the hearing.

The county Department of Health still presented its case and the hearing officer ruled that Smoke Town was guilty.

The county Board of Health voted to increase the fine to $2,100, which is the maximum permitted, and includes all surcharges.

The Board of Health recommended increasing the fine from the original $900 base fine before surcharges in part because of the costs incurred to the county requiring a hearing.

The Board of Health Order will include two points against their license.

For businesses that have three or more points on their license, a letter is sent to the state Tax Department from the county, recommending that their license be suspended for a year.

In a separate case, Harrison-Bauer Corporation doing business as 7-Eleven, located at 518 N. Main St., had sold tobacco products to an individual under 21 years old.

Wuerstle said the company signed an agreement to settle with the county, instead of going to hearing. They were fined $300 plus $250 surcharge.
