Lawsuit filed in Brocton April mishap
A woman is suing the village of Brocton, its fire department and Chautauqua County over an April 2 traffic accident.
Toni Rodriguez, represented by well-known Buffalo attorneys The Barnes Firm, filed suit Nov. 20 in state Supreme Court.
The filing alleges that a vehicle operated by William Hussey, who is also named as a defendant in the suit, hit another car driven by Rodriguez on April 2. Hussey is chief of the Brocton Fire Department, and was allegedly driving a vehicle owned by the village and fire department. He was carrying out official duties at the time, the lawsuit claims.
Hussey’s vehicle struck Rodriguez’s at the intersection of West Main Street and Lake Avenue. Rodriguez “sustained a serious injury,” according to the lawsuit.
The suit was filed in state Supreme Court because Rodriguez “has suffered damages in an amount which exceeds the monetary jurisdictional limits of all lower New York State courts.” She seeks unspecified monetary damages and payment of court costs.
