New agreement reached on state prison strikes

New York State Department Department of Correctional and Community Supervision reported Saturday evening an agreement has been reached in the wildcat strikes taking place at 32 facilities.

In an email, DOCCS said the parties reached a mutual pact that will return staff to work on Monday at 6:45 a.m.

Signed Saturday, the agreement includes DOCCS, the New York State Corrections Officer and Police Benevolent Association Inc. union and the Office of Employees Relations.

The agreement will take effect upon at least 85 percent of staff returning to work. No strike penalties have been waived in the agreement.

Collins Correctional Facilty, which began the strike on Feb. 17, and the Lakeview Incarceration Correctional Facility in Brocton were being impacted.

Addressed in the five-page document are staffing levels, the HALT Act — which remains suspended for the time being — as well as overtime and the use of the National Guard during the work action.

Saturday’s latest deal comes days after corrections officials implored striking prison guards on Thursday to take a last-chance deal to return to work without repercussions, over the objections of their union leaders.

Daniel Martuscello, commissioner of the state Department of Corrections and Community Supervision, said the deal, offered as the illegal wildcat strike reached its 18th day, only applied to those returning to their shifts Friday.

He said the offer reflects provisions sought by striking workers he met on picket lines in recent days.

Among them are promises that striking officers wouldn’t face discipline when they return to work, the reinstatement of those already fired for walking off the job and an immediate restoration of their health insurance benefits.

“I heard my workforce,” Martuscello said in a Zoom call outlining the deal, which the department also posted on its website. “This delivers the things they asked for.”
